What is CBD and is it legal?

CBD, or cannabidiol, is a naturally occurring compound found in the cannabis plant. Like THC, which is also a naturally occurring compound in the cannabis plant, CBD does not have the psychoactive effects associated with THC.

CBD was classified as a controlled substance and was illegal in the United States until the passage of the Agriculture Improvement Act of 2018 (also known as the “2018 Farm Bill”) which was signed and enacted into law in December 2018. The Farm Bill removed industrial hemp from the federal controlled substances list, sparking interest from producers looking to utilize more of the hemp plant.

Under the Farm Bill, hemp is defined as any part of the Cannabis sativa L. plant containing less than 0.3% THC. This includes hemp plants that produce the concentrated liquid extract known as CBD oil. The important part of the legality of CBD involves the explicit percentage of THC in the product (again, less than 0.3% by weight).

However, residents of South Dakota and Idaho should be aware of state laws that are more restrictive. Current South Dakota state law makes industrial hemp and all forms of CBD illegal.

What is a cannabinoid?

A cannabinoid is a chemical compound that reacts with your endocannabinoid system in your body.

Can I fly with CBD?

Can I fly with CBD?After much confusion in the industry, the TSA released a policy on CBD in May of 2019 that says as long as the CBD contains no more than 0.3% THC it is legal to fly with it in either your carry-on bag or your checked bags. We do not recommend traveling with it internationally as US Customs and Border Patrol does not allow the importation of CBD.

Marijuana and certain cannabis infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA. (See the Agriculture Improvement Act of 2018, Pub. L. 115-334.) TSA officers are required to report any suspected violations of law to local, state or federal authorities. 

Will I get “high” using Ellis & Jane CBD? 

No. All Ellis & Jane CBD products contain 0.0% THC, as confirmed by our independent 3rd party lab reports. You you will not feel any psychoactive effects.

Where does your CBD come from?

We work with one of the largest vertically integrated growers in Colorado. They grow, harvest, extract and bottle all of our products. 

How is your CBD extracted? 

Our grower uses a CO2 extraction process. Although it is more expensive, CO2 extraction is better than ethanol/alcohol extraction because it doesn’t use any harmful solvents in the extraction process, resulting in a cleaner CBD product.

How much CBD should I take?

It really depends on what you are using it for, and it is different for everyone. Most people start with between 10mg and 25mg per day and adjust from there. Some people only take 10mg in the morning, others like to take 10mg in morning and 10mg before bed. Others will take it throughout the day as needed. It is difficult to overdose, as you would need to drink a few bottles at once. We recommend that you start with the smallest dose possible. 

What is the best way to take CBD? 

There are a few different ways to take CBD. The most popular method is using the CBD oil sublingually. If you place it under your tongue and hold it there for a few minutes, it absorbs into the bloodstream and you will feel its effects in a few minutes.

CBD softgels are a convenient and precise method to get exactly the dose you desire. The CBD in the softgel is nano-emulsified so it has a smaller molecule. This means that you can absorb more of the CBD than the normal oils. Just remember that when you use a softgel it can take 45 minutes to start working. 

CBD salve is an amazing topical CBD vehicle, because you can focus on a very specific area. All you need to do is rub it in the skin only where you need it. Our CBD salve is amazingly moisturizing, containing beeswax, eucalyptus and lavender!
